Introduction

Welcome to El Patio. By accessing or using our website and services, you agree to abide by these Terms and Service. These terms govern all aspects of your use of the site and any purchases made during our limited buying windows.

Ordering & Purchasing

At El Patio, we offer unique, Spanish-inspired garments designed by artist Álvaro Linares. Our collections are available exclusively just once per month. Orders placed outside of these windows will not be accepted.

Once your order is placed, you will receive an email confirmation. Orders are processed on a first-come, first-served basis, and availability is not guaranteed until your order is confirmed.

All prices are listed in EUR (Euro) and are subject to change at any time without notice prior to purchase. Once your order is confirmed, the price at checkout is final.

Shipping & Delivery

We ship worldwide, except in regions where international shipping restrictions may apply. Shipping costs vary depending on your location and will be calculated at checkout.

Delivery times will depend on your location but typically range from 7 to 14 business days after the order is processed. We aim to dispatch your order as quickly as possible, but unforeseen delays such as customs issues or courier delays may occur. El Patio is not responsible for such delays.

Returns & Exchanges

At El Patio, we take pride in our garments, but we understand that sometimes things don’t work out.

Returns: tems may be returned within 14 days of delivery, provided they are unused, in their original condition, and have all original tags attached. To initiate any return, exchange, or claim (including defective or incorrect items), customers must submit their request through our Returns Request Form. Returns sent without prior approval may not be accepted. Customers are responsible for return shipping costs, unless the item is defective or incorrect.

Exchanges: Exchanges are processed once the original item has been received and inspected. Replacement items will be shipped after approval.

Refunds: Once the returned item is received and inspected, we will notify you of the approval status. Approved refunds will be processed within 14 calendar days and issued to the original payment method.

Legal right to withdraw from the purchase. Return management.

If you are contracting as a consumer, you have the right to withdraw from the sales contract within 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days from the day you receive (directly or through a person collecting the items on your behalf) the products purchased on this website.

To exercise your right of withdrawal, you must notify us via email (at the address contact@elpatio.shop) of your decision to withdraw from the contract through an unequivocal statement. To meet the withdrawal deadline, it is enough for the communication regarding the exercise of this right to be sent before the corresponding 14 calendar days from the delivery have passed.

The return should be made without undue delay and, in any case, no later than 14 calendar days from the date you inform us of your decision to withdraw from the contract. The deadline will be considered met if you return the products before this period expires. Please return the item using or including all its original packaging, instructions, and any other accompanying documents.

In the event of withdrawal on your part, we will refund all payments received from you, including the delivery charges to the original shipping address (with the exception of any additional costs, if applicable, arising from the transportation of the product for its return) without undue delay and, in any case, no later than 14 calendar days from the date you inform us of your decision to withdraw from the contract.

We will make the refund using the same payment method you used for the initial transaction. You will not incur any costs as a result of the refund. However, we may withhold the refund until we have received the products or until you provide proof of their return, whichever condition is met first.

Your right to withdraw from the contract applies only to those products returned in the same condition as you received them. No refund will be made if the product has been used beyond the mere opening of the package or wrapping to verify its nature, characteristics, or functionality, or if it has been damaged, so you should take care of the product(s) while in your possession.

Finally, please note that, even if you are a consumer, you will not have the right to withdraw from the contract whose subject matter is the supply of any of the following products:

  • Goods made according to the specifications of the consumer or clearly personalized (e.g., custom-made clothing).

  • Goods that may deteriorate or expire quickly (e.g., food).

  • Sealed goods that are not suitable for return for health or hygiene reasons and that have been unsealed after delivery.

  • Sealed sound recordings or video recordings, or sealed computer software that has been unsealed by the consumer after delivery.

  • Goods that after delivery and taking into account their nature have been mixed indiscriminately with other goods.

  • The supply of daily newspapers, periodicals, or magazines, except for subscription contracts for the supply of such publications.

Product Descriptions

We make every effort to provide accurate descriptions and images of our garments. However, slight variations in color, texture, or size may occur due to photography and screen settings. El Patio cannot guarantee that your monitor’s display will accurately represent the product.

Intellectual Property

All content on this website, including designs, images, text, and branding, is the exclusive property of El Patio and Álvaro Linares. Unauthorized use, reproduction, or distribution of any material from this site is strictly prohibited.

User Responsibilities

When creating an account or making a purchase, you agree to provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.

Limitation of Liability

El Patio is not liable for any indirect, incidental, or consequential damages arising from the use of our website or the purchase of our products. This includes, but is not limited to, delays in shipping, website errors, or product availability.

Governing Law

These Terms and Service are governed by the laws of Spain, without regard to its conflict of law provisions. Any disputes arising under these terms will be resolved in the courts of Spain.

Amendments

We reserve the right to modify these Terms and Service at any time. Changes will be posted on this page, and it is the user’s responsibility to review the terms regularly. Continued use of our website or services after any amendments constitutes acceptance of the updated terms.

Confirmation of Purchase with Tax Breakdown and Shipping Costs

Once your order is placed, you will receive an automatic email confirmation within 24 hours. This email confirms your order details. The breakdown of taxes and shipping costs is included in the invoice, which is generated through our app. The full invoice, including the breakdown of taxes and shipping fees, will be provided upon request.
